MINUTES OF MAY CITY COUNCIL MEETING STATE OF TENNESSEE CITY OF LEWISBURG COUNTY OF MARSHALL MAY 8, 2007 The Lewisburg City Council met for their regularly scheduled monthly meeting on Tuesday, May 8, 2007, 6:00 p.m. at Lewisburg City Hall, 131 East Church Street, Lewisburg, Tennessee. Those present and attending were: Mayor Bob Phillips, City Manager Eddie Fuller, City Treasurer/Recorder Connie W. Edde, City Attorney Bill Haywood, City Councilmen Hershel Davis, Willie Mitchell, Phil Sanders and Elvin White. Members Absent: None Mayor Phillips called the meeting to order. The Invocation was given by Clay Derryberry and the audience led the Pledge of Allegiance. Item 1. Announcements a. Welcome was given to the incoming Councilmen Quinn Brandon and Robin Minor. It was noted the swearing in ceremony will be held June 1 @10:00 a.m., Lewisburg City Hall. b. Appreciation was given to Roy Lambert for his service to the Lewisburg Water Board. Mr. Lambert has resigned from the Board after approximately 34 years of service. c. Prayers and words of encouragement were given to the grandson of Phil and Jerre Sanders, Michael Chad Welch, and Norman Henson who is in Vanderbilt Hospital. Item 2. Approval of the Minutes Motion was made by Councilman Mitchell, seconded by Councilman White, to approve the minutes of the regular scheduled meeting of April 10, 2007. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 - 0 Item 3. Approval of the Bills and Financial Statement Motion was made by Councilman Sanders, seconded by Councilman White, to approve the payment of the April 2007 bills and the March 2007 Financial Statement. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 Item 4. Citizen Input 1. Jerry Freeman addressed the Council concerning City records he has requested. He also requested the Mayor and Council meet with the public to let them voice their opinions. Mayor Phillips stated anyone wishing to express their opinions with the Council concerning any issue can do so by attending a council meeting and requesting to speak under Citizen Input. Councilman Sanders stated anyone with concerns was welcome to call or come by his home to discuss any matter they wish. Item 5. Unfinished Business None Item 6. New Business 6A. Requesting Unclaimed Balance of Accounts Motion was made by Councilman Mitchell, seconded by Councilman White, to approve a resolution allowing the Lewisburg Water Department to request unclaimed balances of accounts remitted to the state treasurer. The water department will be able to collect unclaimed monies forwarded to the state in the amount of $1,418.36. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 6B) First Reading of Ordinance 07-05 Motion was made by Councilman Sanders, seconded by Councilman Mitchell, to approve first reading of Ordinance 07-05. This ordinance will close alleys lying South of West Commerce and West of Third Avenue South. After purchasing the property known as Home Supply, the Church Street Church of Christ are requesting the alleys between that property and the ally between their property and Al Henderson be closed. The request was supported by Mr. Henderson. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 6C) Consider Additional Fencing at Harmon Playground Motion was made by Councilman Mitchell, seconded by Councilman White, to defer this item to the Recreation Board. 6D) Installation of Traffic Light Motion was made by Councilman White, seconded by Councilman Mitchell, to install a traffic light at the intersection of the Franklin Road and Heil Quaker Avenue. City Manager Eddie Fuller explained that the intersection was rerouted years ago at the request of ICP and is confusing to some residents. With frequent accidents happening in that location, the request has been made to install a traffic light. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 6E) First Reading of Ordinance 07-04 Motion was made by Councilman Sanders, seconded by Councilman Mitchell, to approve first reading of Ordinance 07-04. This ordinance will set the tax rate and approve the budget for fiscal year 2007-2008. A Budget Workshop is scheduled for May 22 @ 4:00 pm, Lewisburg City Hall. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 Item 7. Other Business 7A) It was announced the City of Lewisburg and US Tank will hold a ground breaking ceremony at the new business park on Thursday, May 10 @ 10:00 a.m. 7B) Resolutions Pertaining to the Three Star Program Motion was made by Councilman Mitchell, seconded by Councilman White, to approve resolutions pertaining to the Three Star Program and to adopt a strategic economic development plan for the City of Lewisburg. Upon a roll call vote: Councilman Davis – Aye Councilman Sanders – Aye Councilman Mitchell – Aye Councilman White – Aye Motion Passed: 4 – 0 7C) Resolution Pertaining to Adequate Facilities Tax Revenue Motion was made by Councilman Davis, seconded by Councilman Sanders, to approve a resolution requesting the county share a pro rata portion of the Adequate Facilities Tax with the municipalities within the County. The resolution requests that allocations be made to the municipality that derives revenue from this tax for any new development. 7D) Vietnam Veterans Day, Monday – May 6, 2007. 7E) Councilman Mitchell thanked the citizens of Lewisburg for being able to serve them for the past 12 years. There being no further business to come before the Council, the regular monthly meeting of the Mayor and Council for the City of Lewisburg adjourned at 7:04 p.m.
