MINUTES OF THE NOVEMBER COUNCIL MEETING

 

STATE OF TENNESSEE             CITY OF LEWISBURG          COUNTY OF MARSHALL            NOVEMBER 13, 2007

The Lewisburg City Council met for their regularly scheduled monthly meeting on Tuesday, November 13, 2007, 6:00 p.m. at Lewisburg City Hall, 131 East Church Street, Lewisburg, Tennessee.

Those present and attending were:  Mayor Bob Phillips, City Manager Eddie Fuller, City Treasurer/Recorder Connie W. Edde, City Councilmen Quinn Brandon, Hershel Davis, Robin Minor, and Phil Sanders.  

Members Absent:  Councilman Elvin White, City Attorney Bill Haywood

Mayor Phillips called the meeting to order.

 The Invocation was given by Clay Derryberry and the audience led the Pledge of Allegiance.

 Item 1.  Announcements

 Mayor Phillips announced the following:

          a. To all Veterans: Thank you for your sacrifice and dedication to our Country.

           b.Best wishes for a speedy recovery were given to Councilman Elvin White who is in Maury Regional Hospital.

            c. Letters were read from Representative Eddie Bass and Betsy Craig, President of the Kiwanis Club of Lewisburg, supporting Goats Music and More.

            d. Thank you was given to the street, fire and police departments for their hard work during the festival.

             e. Walk of Heroes dedication held.

              f. Progress can be seen on the Ladies Restroom on the square.

             g. Clearing of property recently purchased by the City on 1st  Avenue is almost completed.

Item 2.  Approval of the Minutes

Motion was made by Councilman Brandon, seconded by Councilman Davis, to approve the minutes of the public hearing and regular meeting of October 9, 2007.  Upon a roll call vote:

Item 3.  Approval of the Bills and Financial Statement

Motion was made by Councilman Minor, seconded by Councilman Sanders, to approve the payment of the October 2007 bills and the September 2007 Financial Statement.   Upon a roll call vote:

Item 4.  Citizen Input

4A)  Tom Sumners requested the Council consider naming the drive leading from Spring Place Road into the Little League Complex “Bobby Hurt Drive”. 

 Motion was made by Councilman Brandon, seconded by Councilman Sanders, to approve the naming of the drive.  Upon a roll call vote:

Item 5.  Unfinished Business

 5A) Resolution for Recycling Program

Motion was made by Councilman Brandon, seconded by Councilman Davis, to approve a resolution to initiate a curbside recycling pickup program for the City of Lewisburg.  Barbara Woods, Curbside Recycling Committee, addressed the Council concerning the resolution.  The committee is recommending a Phase I (southwest portion of the City) to study the results to determine whether or not to continue the program throughout all areas within the City.  The resolution also asked the Council to agree to a matching fund of $10,714 to seek a state grant of $35,714.   The Phase I area will receive twice a week pickup for trash with recyclables collected on Wednesday.  Depending on resident participation, the pickup cycle may go to once a week garbage (Tuesday) and once a week recyclables (Friday).   The Council will also have the right to terminate the project should the participation be less than adequate.  Upon a roll call vote:

5B) Safety Netting at Lewisburg Recreation Center

Motion was made by Councilman Minor, seconded by Councilman Brandon, to approve placing a safety net, contingent to NHC Oakwood’s agreement of sharing the cost, on #1 tee of the Lewisburg Recreation Center.   Guy Chambers addressed the Council and stated the Lewisburg Recreation Board is asking the Council consider ½ of the expense ($2,750).  A letter has been sent to Oakwood seeking approval for their portion.  Upon a roll call vote:

5C)  Final Reading of Ordinance 07-11

Motion was made by Councilman Minor, seconded by Councilman Brandon, to approve third and final reading of Ordinance 07-11, allowing the City Court to levy a litigation tax in the same manner as the state litigation.  Upon a roll call vote:

5D) Second Reading of Ordinance 07-12

Motion was made by Councilman Minor, seconded by Councilman Sanders, to approve second reading of Ordinance 07-12 which will allow rezoning of property lying South of Finley Beech Road.  The owner is requesting the property be rezoned from residential to commercial for the purpose of an auto body shop.  There was a public hearing prior to this meeting with no public opinions or comments.  Upon a roll call vote:

Item 6.  New Business

 6A)  First Reading of Ordinance 07-16

Motion was made by Councilman Brandon, seconded by Councilman Davis to approve first reading of Ordinance 07-16.  This ordinance will annex and zone to medium density residential certain properties lying South of South Ellington Parkway between Mecanico Trail and the Yell Road.  Owners are proposing to construct approximately 50-60 new homes.  Upon a roll call vote:

6B) First Reading of Ordinance 07-13

Motion was made by Councilman Sanders, seconded by Councilman Minor, to approve first reading of Ordinance 07-13 that will rezone certain property fronting Rock Crusher Road from industrial to intermediate business.  Upon a roll call vote:

6C) First Reading of Ordinance 07-14

Motion was made by Councilman Minor, seconded by Councilman Brandon, to approve first reading of Ordinance 07-14 which allows rezoning of certain property fronting Finley Beech Road from medium density residential to intermediate business.  The Planning Commission recommends the rezoning so all properties lying on the South side of Finley Beech Road will be conformed.   Upon a roll call vote:

6D) First Reading of Ordinance 07-15

Motion was made by Councilman Brandon, seconded by Councilman Sanders, to approve first reading of Ordinance 07-15 which allows property known as 430 Darnell Mealer Road to be rezoned from industrial to intermediate business.  The owner of the property is requesting the rezoning for the purpose of operating a motorcycle shop.  Upon a roll call vote:

6E) Reducing Speed Limit on Alley

Motion was made by Councilman Brandon, seconded by Councilman Sanders, to reduce the speed limit to 5 M.P.H. on an alley lying between 2nd Avenue North and the old Hardison School property.  Councilman Brandon asked for the Council to consider the reduction after receiving complaints of speeders cutting through the alley to avoid the red-light on 2nd Avenue.     Upon a roll call vote:

 6F) Consider Merit Pay Raise for City Employees

 A workshop will be held November 27, at 4:00 p.m. to discuss this item.

 Item 7.   Other Business

7A)  Police Advisory Board

 Motion was made by Councilman Brandon, seconded by Councilman Minor, to approve a Police Advisory Board with the following by-laws:

 

POLICE ADVISORY BOARD

Appointed by the Mayor and contains:

1. One Councilman for the length of his/her term.

2. One former police chief for a term of five (5) years / not required to live in city limits.

3. Three (3) citizens: Each with a term of one (1) year / must live in city limits or own property within the city limits.

4. Interim Chief must attend the meetings until a new chief is hired.

Must be an advertised meeting and open to the public once a new chief is hired.

Meetings:      Once a month or as needed.

                        Hear all grievances against Police Department.

                        Hear officer grievances after following the chain                        of command.                     

                        Approves hiring, firing, promotions and demotions.

                        Develops and recommends policies.

                        Recommends Chief and pay for Chief.

7B)  Payment In Lieu of Tax Approved

Motion was made by Councilman Sanders, seconded by Councilman Minor, to approve a resolution from Lewisburg Electric pertaining to payment in lieu of tax.  The total amount paid ($360,590.84) is for fiscal year beginning July 1, 2007 and ending on June 30, 2008.  Upon a roll call vote:

Motion Passed:   4 - 0     

7C) Councilman Brandon requested consideration be given in posting signs that states fines may be enforced for loud music.
